Lokos AI — Terms and Conditions of Use

Welcome to Lokos AI LLC ("Lokos AI," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your access to and use of our websites, products, mobile apps, APIs, and related services (collectively, the "Services").

By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.

1. Eligibility and Accounts

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Services.

When you create an account, you agree to provide accurate and current information and to keep it updated.

You are responsible for maintaining the confidentiality of your login credentials and for all activity conducted under your account.

2. Services Overview

Lokos AI provides artificial intelligence powered analytics, language and voice agents, and business insight tools that enable companies to gather anonymized feedback and individuals to participate in conversational research.

Different interfaces, dashboards, or APIs may be provided to business customers and individual users.

3. Acceptable Use

You agree not to:

  • Use the Services in any unlawful, fraudulent, or deceptive manner
  • Reverse engineer, decompile, or attempt to derive source code from our software or models
  • Upload or transmit viruses, malicious code, or automated scripts
  • Collect, process, or disclose personal data of others without a lawful basis
  • Interfere with normal operation of the Services or attempt unauthorized access

We reserve the right to suspend or terminate accounts that violate these rules.

4. Business Accounts and Companies

Business customers may use the Services to submit or access data, insights, or analytics.

Each business customer is responsible for ensuring that:

  • All provided content complies with applicable law and does not infringe third party rights
  • All necessary consents are obtained from individuals whose data or voices may be processed

Lokos AI acts as an independent data processor and does not assume obligations of a data controller under customer agreements.

5. Intellectual Property

All content, features, and functionality of the Services including software, algorithms, models, designs, trademarks, and documentation are owned by Lokos AI or its licensors and are protected by intellectual property laws.

Except as expressly permitted in writing, you may not reproduce, distribute, modify, or create derivative works of the Services.

You retain ownership of lawful content you submit, but grant Lokos AI a worldwide, royalty free license to use, host, store, reproduce, and create derivative works of that content solely to operate, improve, and analyze the Services.

6. User Data and Feedback

By submitting text, voice, or other inputs, you acknowledge that:

  • Lokos AI may process, analyze, and store data in anonymized or aggregated form to improve its services
  • Aggregated and non identifiable insights may be shared with business clients

Feedback or suggestions you provide are voluntary and may be used without restriction or compensation.

7. Payment and Compensation

Individual participants may receive compensation as displayed in their dashboards or as otherwise agreed.

All payouts are discretionary, subject to verification, and may be withheld if fraud or misuse is suspected.

Business users agree to pay fees according to separate order forms or pricing pages. Fees are non refundable except as required by law.

8. Privacy and Data Security

We maintain administrative, technical, and physical safeguards designed to protect user data.

No system is completely secure, and transmissions over the Internet involve inherent risk.

9. Third Party Services

The Services may integrate third party APIs such as Twilio, OpenAI, or Google Cloud.

Use of third party services is subject to their own terms. Lokos AI is not responsible for third party products or availability.

10. Disclaimers

The Services are provided as is and as available.

We make no warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or non infringement.

Lokos AI does not guarantee uninterrupted, error free, or fully secure Services.

11. Limitation of Liability

To the maximum extent permitted by law:

Lokos AI and its affiliates are not liable for indirect, incidental, consequential, special, or punitive damages, including loss of profits, data, goodwill, or revenue.

Total cumulative liability shall not exceed the greater of USD 100 or the amount paid to Lokos AI for the Services during the three months preceding the claim.

12. Indemnification

You agree to defend, indemnify, and hold harmless Lokos AI LLC, its officers, directors, employees, and contractors from claims arising out of:

  • Your use of the Services
  • Your violation of these Terms
  • Your infringement of third party rights

13. Termination

We may suspend or terminate access at any time if we believe these Terms or applicable law have been violated.

Upon termination, your right to use the Services ends immediately. Sections 5 through 14 survive termination.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of New York, USA, without regard to conflict of law principles.

Disputes shall be resolved exclusively in state or federal courts located in New York County, NY. You consent to jurisdiction.

You agree to attempt informal resolution by contacting info@lokos.ai before filing a claim.

15. Changes to These Terms

We may update these Terms at any time by posting a revised version.

Continued use of the Services after changes constitutes acceptance of the updated Terms.
